Grocery Competition - Queensland
1. Overview

a. The Grocery Competition (Competition) is promoted by Uber Australia Pty Ltd (ABN 49 160 299 865) (we, us or our).

b. By entering the Competition, all entrants (you or your) agree to be bound by these terms and conditions (Terms) and our privacy policy. Any breach of these Terms may result in disqualification from the Competition.

c. To the extent of any inconsistency between these Terms and any other reference to the Competition, these Terms prevail.

d. The Competition:

  • i. begins at 9:00am Australian Eastern Standard Time (AEST) on 10 June 2023; and
  • ii. ends at 11:59pm AEST on 30 June 2023, (Promotion Period).
2. Eligibility

a. This Competition is open to Uber Eats users aged 18 years or over, who are located in Queensland, at the time of entry.

b. Employees and contractors (and their Immediate Families) of Uber Australia Pty Ltd, our Related Bodies Corporate and the agencies associated with this Competition are ineligible to participate in this Competition.

3. How to enter

a. The Competition is a game of chance.

b. To enter the Competition, you must do one of the following during the Promotion Period:

  • i. place, and pay for, an order on Uber Eats, for pickup, or delivery to an address, in Queensland; or
  • ii. complete, and pay for, a ride with Uber, to and from an address in Queensland.

c. You can enter the Competition multiple times.

d. You need an Uber Eats account to enter the Competition.

e. We will not accept entries submitted after the end of the Promotion Period.

f. The time of each entry will be the time and date displayed to us on the Uber or Uber Eats app.

g. We may, at any time:

  • i. verify the validity of entries and entrants (including your identity, age and location); and
  • ii. disqualify any entrant whose entry is not in accordance with these Terms or who otherwise tampers or interferes with the entry process.

h. If there is a dispute as to your identity or details, we reserve the right to determine your identity or details and our determination is final.

4. Instant allocation

a. Each entrant will randomly receive one of the following:

  • i. an entry into the ‘1 Year’s Worth of Groceries on Uber Eats’ major prize draw (Major Prize);
  • ii. a promo code for $5 off your next grocery order on Uber Eats;
  • iii. a promo code for $10 off your next grocery order on Uber Eats;
  • iv. a promo code for $20 off your next grocery order on Uber Eats;
  • v. a promo code for $50 off your next grocery order on Uber Eats; or
  • vi. a promo code for $100 off your next grocery order on Uber Eats.

b. Once the maximum quantity of promo codes set out in clause 6 has been exhausted, all subsequent entrants will receive an entry into the Major Prize draw.

c. We will confirm which prize you have received by push notification. You must ensure your push notification settings are on.

d. Promo code prizes will be automatically applied to entrants’ Uber Eats accounts or sent via email, which will expire 7 days later.

5. Draw for Major Prize

a. There will be 1 winner of the Major Prize (Major Prize Winner). The Major Prize is Uber Eats credit to the value of $150 per week for 52 weeks (total $7,800 in a year), which the Major Prize Winner can use to purchase groceries at select stores in the 'Grocery' category of the Uber Eats app in Australia.

b. The draw for the Major Prize will be conducted on 5 July 2023 at our office at Level 30, 580 George Street, Sydney, New South Wales, 2000.

c. Our draws are final.

d. The Major Prize Winner will be notified by Email on 5 July 2023.

e. It is your responsibility to ensure the email address associated with your Uber Eats account is accurate and up to date.

f. We will publish the name of the Major Prize Winner on t.uber.com/Grocery2023. We may also publish their name on our social media pages or other promotional material. By entering the Competition, you consent to us publishing your details.

6. Total Prize Pool

The total prize pool for the Competition is AUD$9,479,800 (inclusive of any GST), which will comprise:

7. Prize conditions

a. Use of the prizes is subject to the terms and conditions provided by us.

b. The prizes cannot be used to order or purchase alcohol on Uber Eats.

c. The prizes cannot be redeemed on pickup orders on Uber Eats.

d. The prizes cannot be used to pay for delivery fees or service fees on Uber Eats.

e. Delivery fees and service fees may apply to purchases on Uber Eats.

f. We are not liable for any additional, incidental, or related costs in connection with winning the Competition or the prizes offered.

g. You should seek independent advice, including financial advice, as implications (such as tax) may arise as a result of winning the prizes.

h. Prizes are not transferable, saleable or redeemable as cash, credit or equivalent.

8. Entries

a. We are not liable in any way for your entry, to the fullest extent permitted by law.

b. You warrant and agree that:

  • i. you will not submit any entry that is unlawful or fraudulent; and

  • ii. you will comply with all applicable laws and regulations.

9. Personal information

a. Entries may be entered into a database.

b. By entering the Competition, you consent to us:

  • i. collecting your Personal Information for matters related to this Competition;
  • ii. disclosing your Personal Information to our service providers who are assisting us with conducting the Competition; and
  • iii. publishing or disclosing your Personal Information as required by relevant laws or specified in these Terms.

c. You can contact us if you wish to access, or request a correction to, your Personal Information.

10. Liabilities

a. Nothing in these Terms excludes, restricts or modifies any rights or remedies under Schedule 2 of the Competition and Consumer Act 2010 (Cth) that cannot be excluded, restricted or modified.

b. Subject to clause 10(a) and to the fullest extent permitted by law, we and our Related Bodies Corporate (and each of their officers, directors, employees, contractors and agents):

  • i. are not responsible for any error, omission, interruption, delay in operation or transmission, communications line failure or any other event beyond our control. In these circumstances, if we elect to cancel or postpone the Competition, we do so without liability and may reschedule it on the same terms;
  • ii. make no express or implied warranties, representations or guarantees, in fact or in law, regarding the Competition or the merchantability, quality or fitness for purpose of any part of the prizes; and
  • iii. exclude all liability (including for negligence) for any personal injury or loss or damage (including for loss of opportunity, business, goodwill or profits), whether direct, indirect, special or consequential, arising in any way out of the Competition, including where arising out of:
    A. any technical difficulties or equipment malfunction (whether or not under our control);
    B. any theft, unauthorised access or third party interference;
    C. any entry or prize claim that fails to be transmitted or is cancelled, delayed, deleted, interrupted or late (whether or not after our receipt or otherwise);
    D. any variation in prize value or specification;
    E. any tax liability or similar charge incurred by a winner; or
    F. use of a prize by a winner.

c. We are not responsible for any problem or technical malfunction of any telephone network or lines, computer systems, servers, providers or equipment, software, traffic congestion on the internet or any website, or any combination of those, including any injury or damage to entrants or any other person’s computer related to or resulting from participating in the Competition.

d. You are solely responsible for any costs associated with entering the Competition, noting these costs may depend on the internet service provider you use.

e. Without limiting any other terms, you indemnify us and our Related Bodies Corporate (and their officers, directors, employees, contractors and agents) from and against your breach of these Terms.

11. Disruption to Competition

a. If, for any reason, the Competition is affected or interfered with in any way or is not capable of being conducted as planned due to a Force Majeure Event, including where such circumstance corrupts or affects the administration, security, fairness or integrity or proper conduct of the Competition, we may, to the fullest extent permitted by law:

  • i. disqualify any entrant who tampers or interferes with the entry process; or
  • ii. subject to required regulatory approval, cancel, terminate, modify, reschedule or suspend the Competition, as appropriate.

b. Any entrant found to be tampering or interfering with the entry process will have all entries invalidated and any claim to a prize will be invalidated. We will determine whether a breach has occurred at our discretion and may request any documentation.

12. General

a. Any failure to enforce our rights does not constitute a waiver of those rights.

b. To the extent permitted by law, the Competition may be withdrawn or cancelled at any time in our discretion.

c. Any part of these Terms that is illegal, void or unenforceable may be severed, and the remainder will continue in force.

d. At all relevant times, you must comply with the Uber Terms of Use.

e. Unless otherwise stated, the plural includes the singular (and vice-versa).

f. The Competition and any issues relating to the construction, validity, interpretation and enforceability of these Terms will be governed by the laws of New South Wales, Australia.

g. The promoter of the Competition is Uber Australia Pty Ltd (ABN 49 160 299 865) of 580 George Street, Sydney, New South Wales, 3000.

h. If you have any questions regarding these Terms or any issues regarding how the Competition is conducted, you may visit https://help.uber.com/ubereats. We will determine how any issues or disputes will be resolved.

13. Definitions

a. Force Majeure Event means an event or circumstance beyond our reasonable control, including natural disaster, acts of war, riots, vandalism, failure or shortage of power supplies or other essential utility, pandemic, epidemic, quarantine or other widespread or serious threat to human health (including an outbreak or recurrence), strike, a change in applicable law or platform rules, government imposed shutdown or closure, infection by computer virus, bugs, tampering, unauthorised intervention, fraud or technical failures, down time or issues.

b. Immediate Families means any of the following (whether natural, step or adopted): spouse, ex-spouse, de-facto spouse, child, parent, grandparent, uncle, aunt, niece, nephew or sibling.

c. Personal Information has the meaning in the Privacy Act 1988 (Cth).

d. Related Bodies Corporate has the meaning in the Corporations Act 2001 (Cth).
